Platform Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Compare My Build platform, website, and related services ("Platform") operated by Compare My Build ABN 29 071 511 793 ("we", "us", "our").

By registering an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

We may update these Terms from time to time. We will provide at least 14 days' written notice of any material changes before they take effect. Continued use of the Platform after the notice period constitutes acceptance of the updated Terms.

You must provide accurate, current, and complete information when registering an account and keep that information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age and, where registering on behalf of a business, have authority to bind that business to these Terms.

We reserve the right to suspend or terminate accounts that contain false or misleading information.

Builder Profiles and other information displayed on the Platform may include:

• (a) publicly available information sourced from government registers, licensing bodies, business directories, and other publicly accessible sources;
• (b) builder-supplied information provided directly by the Builder or their representatives; and
• (c) estimated or general comparison data generated by us for the purpose of enabling Users to compare Builders, which may be based on industry averages, publicly available data, or modelling and may not reflect the Builder's actual pricing, inclusions, upgrade costs, specifications, promotions, capacity, availability, or current offerings.

We do not warrant the accuracy, completeness, or currency of any information displayed on the Platform. Information may change without notice. Users must verify all material information directly with the relevant Builder before making any decision or entering into any agreement.

Users acknowledge that Builder information displayed on the Platform may be incomplete, simplified, summarised, estimated, or formatted differently for comparison purposes.

We may change the way comparison data, rankings, categories, inclusions, scores, Builder Profiles, or other information is displayed, calculated, prioritised, or presented on the Platform at any time without notice.

We may create and display a Builder Profile using publicly available information even where the Builder has not registered on the Platform or claimed their profile ("Unclaimed Profile").

Unclaimed Profiles are created for the purpose of providing Users with a broader comparison of available Builders and are clearly identified as unclaimed where practicable.

If you are a Builder and wish to claim, update, or remove your profile, please contact us at hello@comparemybuild.com.au. We will use reasonable endeavours to action verified requests within 3–5 business days.

We are not liable for any inaccuracy in an Unclaimed Profile, provided we act promptly to correct verified errors upon request.

The Platform and all content on it are provided for general informational and comparison purposes only. Nothing on the Platform constitutes:

• (a) building or construction advice — we do not assess the suitability, quality, or safety of any Builder's work or services;
• (b) financial or commercial advice — any pricing, cost estimates, or comparison data displayed on the Platform are indicative only and do not constitute a quote, tender, or financial recommendation; or
• (c) legal advice — nothing on the Platform should be relied upon as legal advice regarding your rights, obligations, or any contract you may enter into with a Builder.

Users should obtain independent professional advice (including from a licensed builder, financial adviser, or lawyer as appropriate) before making any significant decision based on information found on the Platform.

The display of a Builder Profile or Listing on the Platform does not constitute an endorsement, recommendation, accreditation, approval, or ranking of that Builder by us.

The order in which Builders appear in search results or comparisons may be influenced by advertising spend, subscription tier, recency of activity, or other commercial factors, and does not reflect our assessment of quality, reliability, or suitability.

Unless expressly stated otherwise, we do not independently verify the licences, qualifications, insurance, credentials, financial standing, or regulatory compliance of Builders listed on the Platform.

We do not guarantee that any Builder displayed on the Platform is currently available, accepting new projects, operating in a particular region, or suitable for a User's requirements.

The Platform facilitates connections between Builders and Homeowners. We are not a party to any agreement entered into between Users and accept no responsibility for the outcome of any such arrangement.

Users must not use the Platform to:

• (a) post false, misleading, or deceptive content;
• (b) engage in conduct that is unlawful, harassing, defamatory, or fraudulent;
• (c) circumvent the Platform to avoid fees or lead charges;
• (d) scrape, copy, or reproduce Platform content without our prior written consent.

We do not guarantee uninterrupted access to the Platform and may suspend, modify, restrict, or discontinue any part of the Platform at any time without notice.

Any dispute between a Builder and a Homeowner is a matter between those parties. We may, at our discretion, assist in facilitating resolution but are under no obligation to do so.

Advertisers may purchase listing packages, featured placements, or lead generation services as described on the Platform at the time of purchase ("Advertising Services").

By submitting a Listing, the Advertiser warrants that:

• (a) all content is accurate, not misleading, and complies with the Australian Consumer Law;
• (b) the Advertiser holds all licences and insurances required by applicable law;
• (c) the Advertiser has the right to use all images, logos, and content included in the Listing.

We reserve the right to reject, remove, or modify any Listing that we reasonably consider to be inaccurate, misleading, offensive, or in breach of these Terms, without liability to the Advertiser.

We do not guarantee any minimum number of views, clicks, enquiries, or Leads resulting from Advertising Services.

Pricing and inclusions: Advertising Services pricing and inclusions are as displayed on the Platform at the time of purchase. While we take reasonable care to ensure pricing and inclusion information is accurate, errors may occur. We reserve the right to correct any pricing or inclusion errors at any time without liability. If an error affects your purchase, we will notify you and offer you the option to proceed at the correct price or receive a refund of any amount paid.

Advertisers indemnify us against any loss, liability, claim, damage, cost, or expense (including legal costs on a full indemnity basis) arising from:

• (a) any false, misleading, or inaccurate information supplied by the Advertiser;
• (b) any breach of applicable laws, including the Australian Consumer Law;
• (c) any infringement of intellectual property rights arising from content supplied by the Advertiser; or
• (d) any dispute between the Advertiser and a Homeowner or other third party.

A "Qualifying Lead" means a Lead that includes valid contact details for a Homeowner who has made a genuine enquiry relevant to the Advertiser's listed services.

Advertisers must notify us within 3–5 business days of receiving a Lead if they consider it does not meet the Qualifying Lead criteria, providing reasons. We will assess the claim at our discretion and may issue a credit at our sole discretion.

We are not responsible for the quality, accuracy, or conversion of Leads beyond the Qualifying Lead criteria set out above.

Certain Advertising Services are offered on a recurring subscription basis ("Subscription"). By purchasing a Subscription, you authorise us to automatically charge your nominated payment method at the start of each billing period until you cancel.

We will notify you by email at least 7 days before your Subscription renews, including the renewal amount and the date on which your payment method will be charged.

You may cancel your Subscription at any time by logging into your account settings or contacting us at hello@comparemybuild.com.au. To avoid being charged for the next billing period, you must cancel at least 3 business days before your renewal date.

On cancellation, your Subscription will remain active until the end of the current billing period. We do not provide pro-rata refunds for unused portions of a billing period, except as required by the Australian Consumer Law.

We reserve the right to vary Subscription pricing on 30 days' written notice. If you do not cancel before the new pricing takes effect, you will be charged at the updated rate from your next renewal date.

Fees for Advertising Services are as set out on the Platform at the time of purchase and are payable in advance unless otherwise agreed in writing.

All fees are stated in Australian dollars. GST is not currently charged. If GST becomes applicable to the Services in the future, applicable GST may be added to fees in accordance with Australian law.

Fees are non-refundable except as required by the Australian Consumer Law or as expressly stated in these Terms.
